Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Kaflow LLC (“Kaflow”, “we”, “us”) about the Estika app and estika.app. By downloading or using Estika, you agree to them. Apple’s Licensed Application End User License Agreement (“Standard EULA”) also applies to the app. These Terms add to it, and where they differ, the Standard EULA governs your license to the app.

1. Who can use Estika

You must be at least 13 years old, and old enough to agree to these Terms where you live. If you are under the age of majority, a parent or guardian must agree to them for you.

2. The app

Estika gives you stretching routines with pictures, written steps, timers and a daily plan. Every routine and stretch is free. Estika Pro, an optional subscription, lets you make any routine your own and build new ones. We may add, change or remove features over time.

3. Estika Pro and the free trial

Estika Pro is sold by Apple through the App Store and billed to your Apple Account. Where Apple offers both, you can choose Yearly, paid upfront, one payment a year, or Yearly, paid monthly, 12 monthly payments over a 12-month commitment. Where it doesn’t, as in the United States, Estika Pro is Yearly, paid upfront.

New subscribers may get a 7-day free trial, once per Apple Account. If you don’t cancel at least 24 hours before the trial ends, your subscription starts, you are charged and, on Yearly, paid monthly, your 12-month commitment begins. The App Store shows the price in your currency before you confirm, with taxes included or added as local law requires.

4. Renewal and cancelling

Your subscription renews automatically for another 12 months unless you cancel at least 24 hours before the end of the current term. You can cancel at any time in Estika, under Profile, Estika Pro, Manage in the App Store, or in your iPhone’s Settings, under your name, Subscriptions. Cancelling stops the next renewal, and you keep Pro until the end of the current term or trial.

On Yearly, paid monthly, cancelling stops the renewal at the end of your 12-month commitment, and the remaining monthly payments of that commitment are still due, unless the law where you live gives you a right to end it sooner. Deleting the app or your data does not cancel a subscription.

5. Price changes

If the price of Estika Pro changes, Apple will tell you in advance and, where required, ask for your consent before charging the new price. On Yearly, paid monthly, the price stays the same until your commitment ends.

6. Refunds

Payments are processed by Apple, and refunds follow Apple’s policies. To request one, go to reportaproblem.apple.com. We can’t issue refunds ourselves. This doesn’t limit any right to withdraw from a purchase or get a refund that the law where you live gives you, which you exercise through Apple.

7. Your health and safety

Estika offers general stretching and mobility routines. It is not medical advice, diagnosis or treatment, and it doesn’t replace a doctor or a physical therapist. Check with a healthcare professional before you start if you have an injury, a medical condition or recent surgery, or if you are pregnant.

Move slowly, stay within a comfortable range, and stop if you feel pain, dizziness or discomfort. The cautions and easier ways in the app are general guidance, and the pictures illustrate each movement. You use Estika at your own risk.

8. Our content and your license

The Estika app and website, and their routines, pictures, words, sounds, names and logos, belong to Kaflow LLC or its licensors and are protected by law. We give you a personal, non-exclusive, non-transferable license to use them on Apple devices you own or control, for your own non-commercial use, as the Standard EULA sets out.

9. What you may not do

Don’t copy, sell, rent, redistribute or publicly show the app’s content; don’t reverse engineer the app, except where the law allows; don’t use bots or scrapers on the app or the website; and don’t misuse the waitlist or the website, or try to get around their security.

10. Your routines and feedback

Routines you build stay on your devices and in your iCloud, and we claim no rights to them. If you send us ideas or feedback, we may use them without any obligation to you.

11. Other services

Estika relies on Apple’s App Store and iCloud, and the website on Cloudflare. Their own terms apply to them, and we are not responsible for them.

12. Availability

We work to keep Estika running well, but we don’t promise that it will always be available, uninterrupted or free of errors. We may suspend or end your access if you break these Terms.

13. Disclaimers

Estika is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Some places don’t allow these exclusions, so they may not apply to you. If you are a consumer, you keep the legal guarantees that the law where you live gives you, for example for digital content that is faulty or not as described, and these Terms don’t take them away.

14. Limitation of liability

To the fullest extent the law allows, Kaflow LLC is not liable for indirect, incidental, special, consequential or punitive damages. Our total liability for any claim about Estika is limited to the greater of what you paid for Estika Pro in the 12 months before the claim, or US$50. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or willful misconduct, or any other liability that the law where you live does not allow to be limited.

15. Governing law and disputes

Apart from the Standard EULA, which sets its own law for your license, these Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Sheridan County, Wyoming, unless the law where you live gives you the right to bring claims in your local courts. If you are a consumer, you keep the protections that the law where you live gives you and that can’t be waived by agreement. If a court finds part of these Terms unenforceable, the rest still applies.

16. Changes to these Terms

We may update these Terms. We’ll post the new version here with a new date and, for significant changes, give notice in the app or on this website. Using Estika after the changes take effect means you accept them; if you don’t, you can stop using Estika and cancel Estika Pro.
